THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.10503 of 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
"to issue writ of Mandamus to declare the action of the 2nd Respondent in issuing Lr.No.JS(P)DS(E)/AS(E)/ PO.C/472/2011, dated 14.03.2016, canceling the Petitioner's candidature for the post of Security Guard, on the alleged ground that the Petitioner has Flat Feet and do not accordingly meet the physical standards prescribed for the said post, without considering his representation dated 26.02.2016 and the Medical Certificate enclosed thereto, as arbitrary, illegal, unjust, violative of the fundamental and constitutional rights guaranteed under the Constitution of India, and violative of the principles of natural justice, and to consequently set aside the aforesaid letter dated 14.03.2016." Heard Sri P. Ramakrishna, learned counsel for the petitioner and Smt. K. Aruna, learned Standing Counsel for respondents.
When the matter is taken up, it is submitted by learned counsel for the petitioner that for redressal of the grievance of the petitioner, the petitioner herein submitted a representation on 2602-2016 to the 1st respondent herein and no orders have been passed on the said representation so far. A request is made by the learned counsel for the petitioner to direct the 1st respondent to pass appropriate orders on the representation, dated 26-02-2016, in accordance with law, by fixing some timeframe. The said request is not opposed by learned Standing Counsel for
respondents and submitted that the said representation would be considered, in accordance with law.
For the aforesaid reasons, the writ petition is disposed of, without expressing any opinion on the merits and demerits of the matter, directing the 1st respondent to consider and pass appropriate orders on the representation, dated 26-02-2016 said to have been submitted by the petitioner herein, in accordance with law, within a period of one month from the date of receipt of a copy of this order.
Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
