ORDER:

The petitioner, who is the daughter-in-law of the deceased regular fair price shop dealer of Sankarapuram Village, Mundlamur Mandal, Prakasam District filed, this writ petition feeling aggrieved by issuance of notification bearing No.R.C.F/4/2011, dated 01.01.2011, by respondent No.3, inviting applications for filling up the vacancy on permanent basis by reserving the same for scheduled caste category.

This Court by order, dated 11.02.2011, directed respondent No.3 not to appoint fair price shop dealer on permanent basis in pursuance of the impugned notification.

At the hearing, it has come out that the erstwhile State Government of Andhra Pradesh has issued G.O.Ms.No.4, dated 28.02.2014, providing for appointment of eligible family members of the deceased fair price shop dealers on compassionate grounds.

In view of this subsequent development, the impugned notification to the extent of Sankarapuram fair price shop is set aside. Respondent No.3 is directed to consider the claim of the petitioner in terms of G.O.Ms.No.4, dated 28.02.2014, and appoint her in place of her deceased father-in-law, if she satisfies the criteria laid down in the said GO. In the event respondent No.3 is not satisfied with the claim of the petitioner, he shall pass an appropriate order giving reasons for rejecting her claim and communicate the same to her. Till this process is completed, respondent No.3 shall not fill up the vacancy on permanent basis. Subject to the above direction and observations, the writ petition is disposed of.

As a sequel to disposal of the writ petition, W.P.M.P.No.3814/11, 9209/12 and W.V.M.P.No.2266/12 shall stand disposed of as infructuous. C.V.NAGARJUNA REDDY, J 01st June, 2015 VGB
