wp_20410_2016 ORDER: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) Seeking release of Ch.Saya Goud (hereinafter referred to as 'the detenu'), the husband of the petitioner, this Writ Petition is filed for issue of habeas corpus. 2.
The detenu was detained on the charges of his involvement in the activities of bootlegging.

Sri Ch.Dhanamjaya, learned counsel for the petitioner, submitted that in case of bootleggers, this Court has been consistently passing orders to the effect that they shall be released subject to the condition of their leaving the place where they have been carrying on their activities and that they shall not re-enter the place till the expiry of the detention period. Learned counsel further submitted that his client has no objection for staying outside Narayankhed limits during the rest of the detention period.

Learned Government Pleader for Home (T.S.) admitted that such orders, as submitted by the learned counsel for the detenu as noted above, are being passed by this Court.

In the light of the above submissions, the impugned detention orders are set aside with the direction that the detenu shall be released forthwith from the detention, if he is not required in any other case (s), subject to his giving an undertaking in writing addressed to respondent No. 2 to the effect that on his release, he will forthwith leave Narayankhed limits and will not re-enter the said limits till the expiry of the balance detention period and handover the same to the Superintendent, Chanchalguda Central Prison, Hyderabad, who shall forward the same to respondent No. 2.

The Writ Petition is, accordingly, allowed to the extent indicated above.
