HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 36862 of 2018 ORDER:
1) Heard learned counsel for the petitioner and learned Government Pleader for Revenue.
2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the inaction of respondent No.2 in disposing of appeal No.A/575/2018 filed under Section 5B of the Telangana State Rights in Land and Pattadar Pass Books Act, as illegal and arbitrary. 3) Learned counsel for the petitioner would submit that though the appeal is filed in the month of February, 2018, till date no orders are passed in the said appeal, causing hardship to the petitioner. He further submits that stay application is said to have been filed before the concerned authorities which is still pending consideration. 4) Learned Government Pleader for revenue would submit that if any stay application is made along with the appeal, the authorities concerned shall immediately pass orders therein.
5) Having regard to the above, the writ petition is disposed of directing the Revenue Divisional Officer to forthwith take up stay application said to have filed in appeal No.A/575/2018, and dispose of the same, in accordance
with law, as early as possible, preferably, within a period of four weeks from the date of receipt of a copy of the order, after hearing all the concerned. Till disposal of the stay application, status-quo as on today to be maintained with regard to entries made in the revenue records in respect of the property in dispute.
