HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.10846 OF 2018 ORDER:

This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973 (for short 'Code'), is filed by the petitioner - accused, to quash the proceedings against him in Calendar Case No.1090 of 2016, pending on the file of the learned XVII Additional Chief Metropolitan Magistrate at Nampally, Hyderabad, registered for the offence punishable under Section 336 of the Indian Penal Code, 1860, on various grounds.

2. But, during hearing, learned counsel for the petitioner, Sri P. Vamsheedhar Reddy, would submit that Non-bailable Warrant was issued and the same is pending for execution and, requested to issue necessary directions to the Magistrate since the petitioner is a student prosecuting his education.

3. Acceding to the request of the learned counsel for the petitioner, I deem it appropriate to permit the petitioner - accused to file appropriate application under Section 70 (2) of the Code, and on his appearance before the Magistrate, the learned XVII Additional Chief Metropolitan Magistrate at Nampally, Hyderabad, is directed to dispose of application, if any, filed under Section 70 (2) of the Code on the same day.

4. With the above direction, the present Criminal Petition is disposed of without touching merits of the case. As a sequel, Miscellaneous Petitions, if any, pending in the present Criminal Petition, stand closed.
