HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.7632 OF 2013 ORDER:

This writ petition is filed seeking a Writ of Mandamus, declaring the action of the respondents in not providing compassionate appointment to the petitioner, as arbitrary and illegal, and sought a consequential direction to the respondents to provide compassionate appointment to the petitioner in any suitable post in pursuance of G.O.Ms.No.2 dated 05.01.2013.

Heard Smt. K. Udaya Sri, counsel for the petitioner, and Sri B.Mayur Reddy, Standing Counsel appearing for the respondents. It has been contended by the petitioner that her husband was employed as a Conductor with the respondents and he has expired on 19.05.2009 while discharging his duties as a Conductor. Thereafter, she has submitted a representation to the respondents on 25.03.2010 requesting the respondents to consider her case for compassionate appointment. But, so far the respondents have not passed any orders on the said representation nor considered the case of the petitioner for compassionate appointment.

Counsel for the petitioner submitted that appropriate orders be passed in the writ petition directing the respondents to consider the representation submitted by the petitioner on 25.03.2010 and pass appropriate orders in accordance with law.

Standing Counsel appearing for the respondents had contended that the case of the petitioner would be considered in tune with the policy of the respondents and appropriate orders would be passed in accordance with law.

This Court, having considered the submissions of the counsel for parties, is of the considered view that this writ petition can be disposed of directing the petitioner to submit a representation afresh, staking her claim for compassionate appointment as well as terminal benefits of her husband, within two weeks from the date of receipt of a copy of this order, and upon such a representation being made, the respondents shall consider the same and pass appropriate orders in another eight weeks thereafter.

With the above directions, the writ petition is disposed of. No order as to costs.
