THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.36850 of 2018 ORDER:

Heard learned counsel for the petitioner, learned Government Pleader for Municipal Administration and Sri Md.Saleem, learned Standing Counsel, apart from perusing the entire material available on record. Auction notice bearing Roc.No.285/2015/A1, dated 17.09.2018, issued by the Commissioner, Yemmiganur Municipality-second respondent herein, is under challenge in the present Writ Petition.

The grievance of the petitioner, in the present Writ Petition, is that, as per Rule 12 of the Receipts and Expenditure Rules, 1968 (for brevity, 'the Rules'), 15% of the shops are earmarked for the members of the Scheduled Caste, and that, in view of the same, he submitted a representation, dated 09.08.2018, for redressal of his grievance, before the second respondent, but no action has been taken so far and, contra to the same, the impugned notification is issued.

On the other hand, learned Standing Counsel, on instructions, submitted that, if any representation, said to have been submitted by the petitioner herein, is pending consideration before the second respondent, the same will be

verified and appropriate action will be taken, in accordance with the said Rules.

Recording the above submission, Writ Petition is disposed of, directing the second respondent to verify the representation, dated 09.08.2018, said to have been submitted by the petitioner herein, and to take further action/pass appropriate orders, strictly in accordance with the Rules. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
