Heard Mr.Gajanand Chakravarthy for petitioner and Mr.Mohammed Habeebuddin for respondents.

The complaint of petitioner is that the respondents have not considered his case for admission into M.P.Ed. under BC-C category and thereby, ignored 1% reservation to BC-C category allotted by the Government. Hence, the action of respondents is illegal and unconstitutional. Hence, the writ petition.

Based on the written instructions, counsel for respondents submits that in M.P.Ed. course, the total intake is 30. The seat matrix as per applicable reservation quota is as follows: "Open - 15 (10 General + 5 Women) --- 50% SC - 5 ( 3 General + 2 Women --- 15% ST - 2 ( 1 General + 1 Women --- 6% BC-A - 2 ( 1 General + 1 Women --- 7% BC-B - 3 ( 2 General + 1 Women --- 10% BC-D - 2 ( 1 General + 1 Women --- 7% BC-E - 1 ( 1 General + 0 Women --- 4%" In view of 1% reservation of BC-C category, it is difficult to provide one seat for 1% in the intake of 30 seats. The reason for not considering the case of petitioner under BC-C category is properly

explained and I am satisfied, there is no irregularity or illegality in the admissions undertaken by respondents.

Writ petition fails and it is accordingly dismissed. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. _____________ S. V. BHATT, J Dt:17.11.2016.
