HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 36789 of 2018 ORDER:
1) Heard learned counsel for the petitioner and learned Government Pleader for Revenue.
2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent Nos.4 and 5 in not demarcating and conducting the survey of land in Survey Nos.602/1, 607, 610 of Ganiatkur village, Kanchikacherla mandal, Krishna District, as illegal and arbitrary.
3) Learned counsel for the petitioner mainly submits that the land which was given to the petitioner - society on lease expired and that the land which was given to the unofficial respondent are getting overlapped to some extent leading to lot of disputes between the petitioner and the unofficial respondents and hence seeks to conduct survey and demarcation of the said land.
4) Having regard to the above, the petitioner shall make a fresh application to the Tahsildar bringing to his notice the problem faced by the petitioner with the unofficial respondent, namely with regard to overlapping of the land leading to disputes, in which event, the Tahsildar - respondent No.4 shall take steps in conducting survey of the
said land. If the authorities are not inclined to extend the lease period to the petitioner and the unofficial respondent societies, they are always at liberty to take steps in accordance with law in getting the lease terminated. 5) With the above direction, the writ petition is disposed of.
