THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR PUBLIC INTEREST LITIGATION No. 88 of 2015 ORDER: (Per the Hon'ble the Chief Justice Sri Kalyan Jyoti Sengupta) This writ petition has been filed for issuance of writ, direction or order particularly in the nature of Mandamus to respondent Nos.1 and 2 not to

entertain any such qualifications in the matter of promotions and other monetary and non-monetary benefits enjoyed by dishonest staff members by fraudulently and unfairly obtaining bogus qualifications from respondent Nos.3 and 4 institutions.

It is difficult for us to comprehend the meaning of the prayer. But, somehow with great difficulty we understand that the respondent Corporation is entertaining the qualification issued by the educational institutions, which are conducting distance education.

According to the petitioner, who is a trade union leader, this sort of qualification is bogus one, and is not approved and permitted by the University Grants Commission.

We are of the view that it is for the employer to decide who should be promoted and what should be the qualification and what should be the proof of qualification, not for the busy body to come and advise. As far as the allegation of fraud and bogus and fictitious certificates are concerned, we do not find any steps have been taken by lodging a first information report or complaint with the police for which any action could be taken. On that ground alone the writ petition is dismissed.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
