ORDER:

This writ petition is filed for a mandamus to set aside building permit, dated 15.10.2015, issued by respondent No.2 in favour of respondent No.4.

At the hearing, Mr.Venkata Mayur, learned counsel for the petitioner, requested for permission of the Court to withdraw the writ petition as respondent No.2 is stated to have issued notices to the petitioner as well as respondent No.4 on the representation of the former for cancellation of the aforementioned building permit granted in favour of respondent No.4.

The Writ Petition is accordingly dismissed as withdrawn with liberty to the petitioner to file a civil suit, in the event any decision adverse to his interests is taken by respondent No.2. As a sequel to dismissal of the writ petition, W.P.M.P.No.50813 of 2015 filed by the petitioner for interim relief shall stand dismissed as infructuous.
