THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37944 OF 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the respondents 2 to 5 in opening the rowdy sheet vide rowdy sheet No.378 against the petitioner as illegal and arbitrary, and consequently to set aside the same. Heard and perused the material.

Learned counsel for the petitioner submits that petitioner was falsely implicated in two crimes, which were registered in 2004 and 2005 and that the petitioner was acquitted in the said two cases. He further submits that the petitioner is not involved in any other crimes and as such, opening and continuation of the rowdy sheet is illegal and arbitrary. He further submits that the petitioner made several representations to the respondents 3 and 5, but no action has been taken by them. Hence, he prays this Court to direct the respondents 2 to 5 to close the rowdy sheet against the petitioner.

Considering the facts and circumstances of the case, the petitioner is directed to make a representation to the fourth respondent stating that the petitioner is not involved in any other crime and no case is pending against the petitioner, and on filing of such application, the fourth respondent is directed to consider the representation and pass appropriate orders.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 22.11.2016 pln
