ORDER:

This writ petition is filed for a mandamus to declare the action of respondent No.2 in not paying compensation to the petitioner in respect of a part of his house, which was demolished by the said respondent, as illegal and arbitrary. Though in strict sense, the petitioner ought to have sought amendment of the prayer in W.P.No.20329 of 2012, which was filed questioning the action of respondent No.2 in seeking to widen the road by demolishing a part of his house without due procedure, Mr.Venkateswarlu Sanisetty, learned counsel for the petitioner, submitted that his client will be satisfied if a direction is issued to respondent No.2 to consider his client's representation, dated 09.10.2015, stated to have been made to the said respondent.

In the light of the above submission, the Writ Petition is disposed of with the direction to respondent No.2 to consider the representation stated to have been made by the petitioner on 09.10.2015 if the same has been received, take an appropriate decision on his request for payment of the compensation in respect of the part of his house, which was allegedly demolished, and communicate the same to him within a period of one month from the date of receipt of a copy of this order. If the petitioner feels aggrieved by the said decision, he may question the same by way of

amendment to the prayer in W.P.No.20329 of 2012. As a sequel to disposal of the writ petition, W.P.M.P.No.47767 of 2015 filed by the petitioner for interim relief shall stand disposed of as infructuous. _________________________ C.V.NAGARJUNA REDDY, J 16th November, 2015 GHN
