THE HON'BLE SRI JUSTICE P NAVEEN RAO CRIMINAL PETITION No.64 OF 2015 ORDER:

This criminal petition is filed under Section 438 of Cr.P.C by petitioners /accused Nos.1 to 3 in FIR No.4 of 2015 of Dharmaram Police Station, Karimnagar District for the offences punishable under Section 3(1)(x) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989. Heard the learned counsel for petitioners and learned Additional Public Prosecutor for respondent -State and perused the material placed on record. The allegation against the petitioners/accused is that on 01.01.2015 at about 8.00 a.m. the petitioners/accused abused the defacto complainant in filthy language touching the caste.

Learned counsel for petitioners submitted that petitioners are falsely implicated into the crime and the allegations alleged against them in the complaint do not constitute any offence and in abuse of process of law. Having regard to the above, the Criminal Petition is disposed of by giving liberty to petitioners/accused to surrender before the learned Special Judge concerned and to move regular bail application after notice to the public prosecutor and in such an event the learned Judge concerned is required to consider on its own merits the application to grant bail preferably on the same day, if not atleast on next day and subject to such conditions as may be necessary. ________________ P NAVEEN RAO,J DATE: 13.1.2015 Rns/Va
