THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.43277 of 2016 ORDER:

In this writ petition, the petitioner seeks a direction to the 2nd respondent not to interfere with the construction work being carried on by the petitioner on Plot No.6 in Sy.No.1366 of Vavilalapally, Karimnagar District at the instance of respondents 3 to 5. The main grievance of the petitioner is that having purchased the plot in question from the original owner for a valid consideration and after obtaining the building permission he is proceeding with the construction work. However, at the instance of respondents 3 to 5 herein, the 2nd respondent is interfering with the construction activity without there being any authority and thereby interfering with the civil dispute pending between the petitioner and the unofficial respondents.

The learned Government Pleader for Home submitted that there is no case pending against the petitioner and that the 2nd respondent is not interfering with the construction activity of the petitioner. Considering the facts and circumstances of the case, without going into the merits of the case, the 2nd respondent is directed not to interfere with the construction activity being carried on by the petitioner over the Plot No.6 in Sy.No.1366 of Vavilalapally, Karimnagar District without following the due process of law.

Accordingly, the writ petition is disposed of. No order as to costs. Pending Miscellaneous Petitions, if any, shall stand closed. _________________ RAJA ELANGO,J 14.12.2016.
