HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 36822 of 2018 ORDER:
1) Heard learned counsel for the petitioner and learned Government Pleader for Revenue.
2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent No.3 in not passing orders in the stay petition filed in appeal registration No.23 of 2018 by the petitioner under Section 4(A) of A.P. Assigned Lands (POT) Act, 1977, against the order dated 17.09.2018, in Rc.A-56/2018, passed by the Tahsildar, Kankipadu mandal, Krishna District, in respect of 0.04 1⁄2 cents of land in R.S.No.156/3 B of Proddutur village, Kankipadu mandal, Krishna District, as illegal and arbitrary.
3) Learned counsel for the petitioner would submit that the appeal filed before the Revenue Divisional Officer - respondent No.3 came to be adjourned to 24.10.2018 and that if interim orders are not passed therein, the petitioner would be put to irreparable loss.
4) Learned Government Pleader for revenue would submit that if any stay application is made along with the appeal, the authorities concerned shall immediately pass orders therein.
5) Having regard to the above, the writ petition is disposed of directing the Revenue Divisional Officer to dispose of appeal No.23 of 2018, within a period of six months from today. If any stay application is filed along with the said appeal, the authorities concerned shall pass orders in the said application, within a period of two to three weeks from the date of receipt of a copy of the order. Meanwhile, if the petitioner is in possession of the property, the authorities shall not dispossess them, except in accordance with law. 6) Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
