ORDER

With the consent of learned counsel on either side, this writ petition is disposed of at the admission stage. This writ petition is filed seeking the following relief: "... to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondent in suspending the petitioner into service as Director (Planning) HMDA vide its Order G.O.Rt.No.92, dated 3.2.2018 is illegal, arbitrary and avoid and opposed to Articles 14, 19 and 21 of Constitution of India, contrary to the procedure prescribed under G.O.Ms.No.86, dated 8.3.1994 including law laid down by the Hon'ble Supreme Court in the case of Ajay Kumar Chowdhary vs. Union of India reported in 2015(7) SCC 291 and consequently to direct the respondent to reinstate the petitioner into service and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Heard Sri C.V.Mohan Reddy, learned Senior Counsel appearing for the petitioner and learned Government Pleader for Services-III appearing for the respondent. Learned counsel appearing for the petitioner submits that while working as a Director (Planning) HMDA Head Office, Tarnaka, Hyderabad, the petitioner was placed under suspension vide G.O.Rt.No.92, dated 3.2.2018, on the allegation of possessing assets disproportionate to the known source of income and that as per G.O.Ms.No.86, dated

8.3.1994, the respondents are bound to review his case as he was placed under suspension for more than 6 months. Learned Government Pleader appearing for the respondent contends that the case of the petitioner will be reviewed in terms of G.O.Ms.No.86, dated 8.3.1994. Having considered the rival submissions made by the learned counsel on either side, this writ petition is disposed of directing the respondent to review the suspension of the petitioner in terms of G.O.Ms.No.86, dated 8.3.1994 and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order. No costs. Miscellaneous petitions, if any, pending shall stand closed.
