THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.42859 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the action of the respondents in not providing alternative employment in terms of Section 47 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Participation) Act, 1995, inspite of repeated visits made by the petitioner followed by the written representation dt. 14-12-2015, as being illegal, arbitrary and unjust and consequently direct the respondents to provide the alternative employment to the petitioner duly paying the salaries and other attendant benefits from the date of declaring unfit to till providing the alternative employment."

Heard, Sri G. Rajesh, learned counsel for the petitioner and Sri A. Ravi Babu, learned Standing Counsel for respondents. When the matter is called it is represented by learned counsel for the petitioner so also learned Standing Counsel for respondents that the issue in the present writ petition is squarely covered by an order passed by this Court in writ petition No.24560 of 2015, dated 27-08-2015 and a copy of the same is placed on record as material paper.

In view of the same and for the reasons recorded therein, this writ petition is disposed of directing the respondentsCorporation to provide the petitioner with alternative employment by maintaining the pay scale of driver and also pay him the salary

for the interregnum period i.e., from 29-06-2015 till he is provided with alternative employment. The entire exercise shall be completed by the respondents-Corporation within a period of eight

(8) weeks from the date of receipt of a copy of this order. Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
