THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.12431 of 2016 ORDER:

The petitioner-accused preferred the present Criminal Petition under Section 482 of the Code of the Criminal Procedure (Cr.P.C.), challenging the order dated 26.07.2016 in Crl.M.P.No.101 of 2016 in Crl.M.P.No.74 of 2016 in crime No.7 of 2016 of Hiramandalam Police Station, passed by the Judge, Family Court-cum-III Additional District & Sessions Court, Srikakulam.

Vide order dated 17.02.2016 in Crl.M.P.No.74/2016 the petitioner was granted anticipatory bail by the Judge, Family Court, directing him to surrender before the Judicial Magistrate of First Class, Kotturu, within 15 days therefrom and on such surrender the learned Magistrate was directed to release the petitioner on his executing personal bond for Rs.10,000/- with two sureties for a like sum each to the satisfaction of said Magistrate. Petitioner was further directed to attend before the Station House Officer, Hiramandalam Police Station, between 8 a.m. and 10 a.m. on every Monday and Thursday till filing of charge sheet. Thereafter, petitioner filed Crl.M.P.No.101 of 2016 seeking relaxation of the condition of appearing before the SHO, which was rejected by the learned Sessions Judge on the ground that investigation is still pending. As against the same, present petition is filed. Heard the learned counsel for the petitioner as well as the learned Public Prosecutor.

It is represented by the learned counsel for the petitioner that the petitioner has been complying with the condition imposed by this Court for the last six months; that great inconvenience is caused by reason of the said condition and hence prays to relax the condition. It is represented by the learned Public Prosecutor that the petitioner is complying with the condition, but however his presence is

required since the investigation is still pending. Since substantial investigation is over and as the petitioner has been complying with the conditions, reporting before the S.H.O. concerned on every Monday and Thursday between 8.00 a.m. and 10.00 a.m., until further orders, is modified and instead the petitioner shall appear before the SHO concerned on 1st and 15th of every calendar month starting from 01.09.2016 for a period of three months or till filing of charge sheet, whichever is earlier.
