HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO WRIT PETITION No.38371 of 2015 O R D E R :

In this writ petition, the petitioners assail the action of the respondents in not providing house sites to them, even though they were displaced for construction of Yeleswaram Project under the policy of Resettlement and Rehabilitation for Project Affected Families, 2005, framed vide G.O.Ms.No.68, Irrigation & CAD (Project Wing - LA IV - R & R) Department, dated 08.04.2005. The petitioners claim to have made a representation dated 07.09.2015 to respondent Nos.2 and 9, in this regard.

2. Learned counsel for the petitioners has relied upon the order dated 27.11.2012 passed by this Court in W.P.No.30697 of 2012, wherein this Court had issued certain directions to the 1st respondent, on a similar plea raised by an Association of Displaced Persons.

3. Learned Government Pleader for Irrigation states that similar order be passed even in this writ petition.

4. Having regard to the said submission and also having regard to the above order passed by this Court, this writ petition is disposed of directing the 1st respondent to take expeditious decision to examine the proposals of 3rd respondent to give approval to the same, unless the 1st respondent finds legally sustainable objections, without further loss of time. The 1st respondent shall also take appropriate decision and communicate the same to the 3rd respondent, within a period of one month from the date of receipt of a copy of this order. Upon receiving the decision of the 1st respondent, the 3rd

respondent shall act with expedition and do needful for allotment of house sites to the identified beneficiaries, including the petitioners herein, if they are found eligible for the same. As a sequel, miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs. _____________________________ M.S. RAMACHANDRA RAO, J 25.11.2015.
