The case of the petitioners is that their lands in question situated in Rowthugudem village, Jeelugumilli mandal, West Godavari district, are sought to be taken by the respondents for Polavaram Irrigation Project and for that purpose, preliminary notification under Section 11 (1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, (for short, "the Act") was published on 04-07-2016. 2.

The grievance of the petitioners is that no further steps are being taken in the matter pursuant to the notification under Section 11 (1). This Court granted interim order on 02-01-2017 and extended from time to time. No counter affidavit is filed in the matter till date.

In the circumstances, suffice it direct the respondents not to interfere with the lands in question of the petitioners including with their possession, without taking further steps in the matter in pursuance of the preliminary notification issued under Section 11 (1) of the Act. However, this order will not preclude the respondents from proceeding in the matter in accordance with the procedure contemplated under the provisions of the Act. 4.

With the above directions, the writ petition is disposed of. Miscellaneous petitions, if any pending in this case are disposed of. There shall be no order as to costs.
