HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.3 6 8 3 1 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Sub-Inspector of Police, Anantagiri Police Station, Suryapet District, dated 10.10.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "The petitioner herein has approached the Police of Ananthagiri Police Station, Suryapet District, and lodged a complaint on 30.08.2018, stating that his mother Smt.Linga Rama Tar is the owner of the land to an extent of Ac.0.30 gts., in Sy.No.418/ E1 and Ac.5.00 gts., in Sy.No.437/ 1 situated in Ananthagiri village and mandal, and the said lands were mutated in revenue records and issued pattadar passbook and title deed and that on 30.08.2018 Mr.B.Srinu and Mr.B.Bhagya Rao have trespassed into their land and when he questioned them, they threatened with dire consequences and hence requested the Police to take necessary action as per law.

Upon receipt of the said petition, an entry was made into the Station General Diary on 30.08.2018 itself, after enquiry action will be taken.

In the preliminary enquiry, it is clearly revealed that the dispute of the petitioner herein as well as the unofficial respondents is purely civil in nature and both are claiming rights and title over the subject property in question and immediately, this respondent advised the petitioner to seek his redressal in a competent Court of law.

To that effect, a receipt, dated 30.08.2018, was also issued to the petitioner herein informing him that it is purely civil dispute and hence to seek redressal in a competent Court of law.

It is humbly submitted that since the dispute of the petitioner herein as well as the unofficial respondents herein is purely civil in nature as they claiming rights and ownership of the subject property in question and hence no action was taken on the complaint of the petitioner herein except advising him to seek his redressal in a competent Court of law.

A copy of the receipt, dated 30.08.2018, is annexed to this written instructions for the kind perusal of this Hon'ble Court."

Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the Sub-Inspector of Police, Ananthagiri Police Station, Suryapet District, dated 10.10.2018. However, it is open for the petitioner herein to avail the other remedies open, in accordance with law. Miscellaneous petitions pending, if any, shall stand disposed of.
