THE HON'BLE SRI JUSTICE M.S.K. JAISWAL CRIMINAL PETITION No.4340 OF 2015 ORDER:

This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973, to quash the proceedings in P.R.C.No.15 of 2015 on the file of learned Judicial Magistrate of First Class, Thorrur, Warangal District.

Heard both sides.

Having regard to the facts and circumstances of the case, I am not inclined to quash the proceedings in P.R.C.No.15 of 2015. However, the petitioner is directed to appear before the committal Court and file an application to recall the warrant as per Section 70

(2) Cr.P.C. within a period of one month from today. In such an event, the learned Magistrate shall consider and dispose of the application of the petitioner on the same day on which it is filed on reasonable terms, in accordance with law. Further more, the presence of the petitioner/accused during the committal proceedings stands dispensed with.

Subject to the above, the Criminal Petition is disposed of. Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
