ORDER

This writ petition is filed seeking to issue a Writ of Mandamus directing the respondent to consider the case of the petitioner for the post of Fireman/Washerman/Barber, taking into consideration of long standing service rendered by him.

Heard Sri M.Venkatramana, learned counsel appearing for the petitioner and Sri K.Lakshman, learned Assistant Solicitor General, appearing for the respondent. It is the case of the petitioner that he is working as a Waiter in the respondent-Military College of Electronics & Mechanical Engineering situated at Thirumalghery, Secunderabad, from 1.7.2005 and he rendered more than 10 years of service, on temporary basis. While so, the respondent had issued a recruitment notification No.PIN 900453 C/o 56 APO, on 13.12.2014 to the posts of Washerman, Fireman, Barbar and the last date for submission of the application is 3.1.2015. Pursuant to the said notification, the petitioner applied and participated in the selection process.

The apprehension of the petitioner is that as he has crossed the upper age limit, the respondent may not consider his case.

Learned Assistant Solicitor General appearing for the respondent submits that the maximum age limit prescribed as per the notification is 25 years, which is relaxable in respect of SC and ST candidates and since the petitioner has already participated in the selection process and if the case of the petitioner comes within the zone of consideration, definitely, his case would be considered for appointment. Having considered the rival submissions made by the learned counsel on either side, this Court is of the considered view that the apprehension of the petitioner that his case would not be considered as he crossed the upper age limit, is incorrect. As the petitioner belongs to SC community, he is entitled for relaxation of age upto 35 years. Therefore, ends of justice would be met if the respondent is directed to consider the case of the petitioner for appointment to the post of Washerman/Fireman/Barbar.

Accordingly, the Writ Petition is disposed of directing the respondent to consider the case of the petitioner for appointment to the post of Washerman/Fireman/Barbar, in accordance with the selection process, if he comes within the

zone of consideration for appointment in any of the said posts, as per rules. No costs.

Miscellaneous petitions, if any, pending shall stand closed.
