THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.36887 of 2018 ORDER:
Heard learned counsel for the petitioner and the learned Government Pleader for Home, apart from perusing the entire material available on record.
When the matter is taken up, written instructions, dated 10.10.2018, furnished by the Inspector of Police, Kala;ather Police Station, are placed on record by the learned Government Pleader. The said instructions, to the extent of their relevance to the present Writ Petition, are as under:
"It is submitted that as per the station records, as of now, no criminal cases are pending against the petitioners on the file of respondent No.4-Station House Officer, Kalapather police station, Hyderabad.
It is submitted that the contentions of the petitioners that the 4th respondent Station House Officer, Kalapather police station summoned the petitioners to the police station at the behest of the 6th respondent and directed the petitioner to settle the issue with the 6th respondent is incorrect, baseless, far from truth and has been created for the purpose of filing the present writ petitioner.
It is submitted that 4th respondent did not summon the petitioners to the police station or directed the petitioners to settle the alleged issue with the 6th respondent Saher Lubana at any point of time". By placing on record the above written instructions, Writ Petition is disposed of, directing the respondents herein not to call the petitioner to the police station, unless the said course of action is permissible in accordance with law. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
