THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO C.R.P.No.3519 of 2014 O R D E R :

This Civil Revision Petition is filed under Article 227 of the Constitution of India seeking a direction to the Judge, Family court, Ongole to dispose of Crl.M.P.No.87 of 2012 and CFR.No.44 of 2012 in MC.No.21 of 2010 on his file.

2. This Court on 07.09.2015 directed the Judge, Family Court, Ongole to submit a report as to why the petitioner's application Crl.M.P.No.87 of 2012 to set aside the order dt.01.07.2011 in MC.No.21 of 2010 was kept pending and has not been disposed of even though more than 3 1⁄2 years have elapsed since its filing.

3. The report of the VII Additional District Judge, Ongole FAC Judge, Family Courtcum-VIII Additional District Judge, Ongole is placed on record, which shows that Crl.MP.No.87 of 2012 was allowed on 28.01.2015 on payment of costs of Rs.500/- by the petitioner and later the CFR.No.44 of 2012 was also numbered as Crl.MP.No.100 of 2015 and is now coming for respondent's counter.

4. After perusing the said report, the Judge, Family Court-cum-VIII Additional District Judge, Ongole, is directed to dispose of Crl.MP.No.100 of 2015 (CFR.No.44 of 2012 filed under Section 126(2) Cr.P.C.) in MC.No.21 of 2010 on his file within two (02) months from the date of receipt of copy of this order, positively.

5. With the above direction, this Civil Revision Petition is allowed. There shall be no order as to costs.

6. Consequently, miscellaneous petitions pending, if any, shall stand dismissed. _____________________________
