THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.23121 OF 2016 ORDER:

Heard the learned Counsel for the petitioner and the learned Government Pleader for Home. With consent of the counsel appearing for both parties, the present Writ Petition is disposed of at the admission stage.

2. Since this Court is not adjudicating the matter on merits, hearing of the unofficial respondents may not be necessary.

3. The present Writ Petition is filed with the following prayer: "to issue an appropriate writ, order or direction, more in the nature of mandamus, declaring the action of the 3rd respondent in harassing the petitioner by calling the petitioner to the police station everyday by sending the constables to the police's house daily at the behest of respondents 4 and 5 herein, without any manner of right and jurisdiction even though 3rd respondent is well aware that the disputes if any between the petitioner and respondents 4 & 5 and others are purely civil in nature, as illegal, violative of Articles 14,19, 21 of Constitution of India and consequently direct the 3rd respondent not to harass and interfere with freedom and liberty of the petitioner by interfering in the civil disputes between the petitioner and respondents 4 and 5 and others."

4. The grievance of the petitioner appears to be that respondent No.3 is illegally and intentionally calling the petitioner to the police station and forcing to vacate the premises.

5. Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to the respondents-police not to force the petitioner to vacate the premises and not to interfere with his possession and

enjoyment.

6. Learned Government Pleader for Home submits that allegations made in the writ petition are all false and the respondents will not take steps without following due process of law.

7. Having regard to the above, the Writ Petition is disposed of directing the respondents-police not to force the petitioner to vacate the premises in question and not to interfere with his possession and enjoyment over the premises in question without following due process of law.

Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
