THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.36872 OF 2018 ORDER :
Heard learned counsel for the petitioner and the learned Government Pleader for Home, apart from perusing the entire material on record.
When the matter is taken up, written instructions, dated 10.10.2018, furnished by the Sub Inspector of Police, Kushaiguda Police Station, are placed on record by the learned Government Pleader. The said instructions, to the extent of their relevance to the present Writ Petition, read as under:
"On a complaint of Sri Y.V.Rama Rao, son of Y.R.Rao, resident of Defence colony, SEcunderabad lodged with the police of Kushaiguda Police Station, a case in Cr.No.740/2018 U/Secs.447. 427 IPC dated 8.10.2018 was registered against the petitioner herein and others as they came in Innova Car and criminally trespassed into his wife's plot No.57 with 300 sq yards in Sy. No. 13 and 14 (a civil O.S.No.1848/2010 filed by him is pending) by break open the compound wall and stated the construction work despite resistance by the colony people and investigation was taken up.
The FIR was registered on 8.10.2018. The petitioner herein is shown as Al in the FIR. The investigation is at the beginning stage. Necessary steps will be taken against the petitioner basing on the outcome of the investigation into the case following the due procedure.
Except registration of the above crime and proceeding with the investigation into the case as contemplated under law, this respondent never interfered with the subject property in question. To escape from his criminal overt acts the petitioner filed the present writ petition.
The petitioner herein is required in connection with the above case for the purpose of investigation into the same.
It is pertinent to submit that if the petitioner makes Mr.Y.V.Rama Rao on whose complaint, the above case is registered as party to this writ petition, the real would have come to light". By placing on record the above written instructions, Writ Petition is disposed of. There shall be no order as to costs.
