THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 36975 of 2014 ORDER:

This writ petition is filed questioning the inaction of the respondents 3 and 4 in granting title deeds in respect of dry land in an extent of Ac.10-00 cents in Survey No.521 CP (old) and Survey Nos. 949-3, 949-4, 949-5A, 949-6 & 951-6 (new) of Kolanakuduru village, Manubolu mandal, SPSR Nellore district, though pattadar passbooks were issued in favour of the petitioner.

2. A counter affidavit has been filed sworn by the Tahsildar, Manubolu mandal, SPSR Nellore district. The facts are not in dispute.

3. A perusal of the counter affidavit would reveal that the petitioner's request for grant of title deeds is delayed only on account of the fact that certain record is required to be received from the authorities below. In paragraphs 6 and 8 of the counter affidavit, it is stated as follows:

"In reply to Paras 5 to 8 of the affidavit, it is submitted that the on her application U/s 6A(2) of the A.P. ROR Act, 1971 for issue of Title Deed for the above lands, the Revenue Divisional Officer, Nellore has called for a report in the matter in Rc.D1/2013, dt.29.09.2014. Thereupon a notice was issued in this office Rc.B410/2014, dt.07.10.2014 to the petitioner to file the Original D-Form pattas for onward submission to the Revenue Divisional Officer, Nellore. He has filed the same in this office. The Respondent No.4 i.e., the Tahsildar, Manubolu has submitted a report in his Rc.B.410/2014 dt.13.10.2014 to the Revenue Divisional Oficer, Nellore i.e., Respondent No.3 furnishing all the above details along with the copy of DKT Register, combined sketch and the original D-Form Pattas.

Hence action for issue of Title Deed in her favour for the subject lands is under process." "It is submitted that the particulars called for were submitted by the Tahsildar, Manubolu Respondent No.4 along with the copy of DKT Register, combined sketch and the original D-Form pattas. Vide Rc.B.410/2014, dt.13.10.2014 in response to the letter Rc.D1/2013, dt.29.09.2014 of the Revenue Divisional Officer, Nellore."

4. Sri Veera Swamy, learned Government Pleader appearing on behalf of the respondents, submits that a little more time is required for the purpose of issuance of title deeds as the matter is already taken up for consideration and the process is on.

5. Considering the counter affidavit, the writ petition is disposed of with a direction to the respondent authorities to complete the process of grant of title deed in terms of the prayer of the petitioner, within a period of twelve weeks from the date of receipt of copy of this order. No costs.
