HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Criminal Petition Nos.6007 and 9501 of 2014 COMMON ORDER :
The petitioners 1 to 3 in Crl.P.No.6007 of 2014 and the petitioner in Crl.P.No.9501 of 2014 are A.1 to A.3 and A.4 respectively in Cr.No.305 of 2014 of KPHB Colony Police Station, Kukatpally, registered for the offences punishable u/ sec.420, 468, 471 and 506IPC on the complaint of the 2nd respondent-defactocomplainant. Heard the learned counsel for the respective petitioners and the learned counsel for the 2nd respondent-defacto-complainant and also the learned Public Prosecutor representing the State in both the matters. From several contentions raised by the counsel for the petitioners, coming to the counter of the 2nd respondent-defacto-complainant, it is stated ultimately at paras-8 and 9 to allow the petition by quashing the FIR so far as against the petitioners in Cr.No.
305 of 2014 of KPHB Colony Police Station, Kukatpally which is virtually settlement between the accused and the defacto-complainant to compound the non-compoundable offence though no such petition filed. By considering to that extent, the Criminal Petitions are allowed by quashing the proceedings in Cr.No.305 of 2014 of KPHB Colony Police Station, Kukatpally against the respective petitioners/ A.1 to A.3 and A.4 and they are acquitted. Their bail bonds shall stand cancelled. It is made clear that if at all in future there is any cause of action in relation to the matter arises that may not be a bar much less a prejudice on third party right.
