The Hon'ble Sri Justice C.V.Nagarjuna Reddy Writ Petition No.40453 of 2012 Dated 27.08.2015 Between:

Nelluri Pullayya and 76 others ... Petitioners and The Superintendent Engineer APCPDCL Nalgonda District and 3 others

...Respondents

Counsel for the Petitioners: Mr.P.Chandrasekhara Reddy Counsel for the respondents: Mr.R.Vinod Reddy, SC for TS Transco The Court made the following:

Order:

This Writ Petition is filed by the petitioners, who are 77 in number, with the grievance that though they are small farmers owning meagre extents of agricultural lands, the respondents have demanded huge amounts, purportedly, towards arrears of electricity charges, ignoring the fact that they are entitled to the benefit of free power supply under the scheme introduced by the respondents. Mr.R.Vinod Reddy, learned Standing Counsel

for the Telangana State Southern Power Distribution Corporation Limited (the successor to the Andhra Pradesh Central Power Distribution Company Limited), on instructions, submitted that the respondents have held negotiations with the petitioners and that an amicable settlement is being arrived at.

The learned Counsel for the petitioners submitted that he has no instructions in this regard. Inasmuch as the learned Standing Counsel submitted that the dispute is being resolved by the respondents themselves, adjudication of this Writ Petition on merits is not necessary.

The Writ Petition is, accordingly, disposed of as infructuous, however, with liberty to the petitioners to avail a fresh remedy, in the event the respondents continue to proceed with the demand of electricity charges in connection with their respective agricultural service connections.

As a sequel to disposal of the Writ Petition, interim order, dated 18-02-2013, is vacated and WPMP.Nos.51307 of 2012 and 2299 of 2013, filed by the petitioners for interim relief, are disposed of as infructuous.
