ORDER:

This contempt case is filed alleging willful disobedience of the order, dated 02.01.2014, in W.P.No.39377 of 2013. At the hearing, Mr.V.Jagapathi, learned counsel for the petitioner, has admitted that before filing this contempt case, his client has not issued notice to the respondent alleging willful violation of the aforesaid order of this Court. The contempt proceedings being quasi criminal in nature, the petitioner is not entitled to invoke the jurisdiction of this Court for punishing the respondent unless the latter is informed about the alleged violation and calling upon him to refrain from doing so. As the petitioner failed to follow this procedure, I am not inclined to entertain this contempt case.

The Contempt Case is accordingly dismissed with liberty to the petitioner to put the respondent on notice and if the latter still interferes with his possession of the property, he shall be free to avail fresh remedy.
