Order:

This Writ Petition is filed for the following substantive relief:

"to issue a writ, order or direction more particularly one in the nature of writ of Mandamus declaring the action of respondent Nos.2 and 3, in not acting on the representation, Dt. 07.05.2011, made by the 2nd petitioner to stop the work of closure of the tank namely Muthukur Village tank situated in Survey Nos.443 to 450 &

452 to 456 of Muthukur Village and Mandal, SPSR Nellore District, as erroneous, arbitrary and violative of Articles 14 and 21 of the Constitution of India and consequently, to direct respondent Nos.2 to 5 to see that the said tank is not closed."

At the hearing, Mr.T.C.Krishnan, learned Counsel for the petitioners, submitted that the cause in this Writ Petition does not survive for adjudication and that the Writ Petition has become infructuous. The above submission of the learned Counsel for the petitioners is placed on record and the Writ Petition is, accordingly, dismissed as infructuous. As a sequel to dismissal of the Writ Petition, interim order, dated 18-05-2011, as extended on 2706-2011, is vacated and WPMP.No.17125 of 2011, filed by the petitioners for interim relief, is disposed of as infructuous.
