HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CONTEMPT CASE NO.450 OF 2016 ORDER: (per Hon'ble the Acting Chief Justice Ramesh Ranganathan) After orders were reserved on 11.08.2017, a request was made, by the Government Pleader for Industries on 16.08.2017, that the matter be listed under the caption 'for being mentioned'. Consequently the matter is listed under the caption 'for being mentioned' today.
Learned Government Pleader for Industries would draw our attention to the Additional counter-affidavit filed by the respondent wherein it is stated that the Assistant Director, Mines and Geology (Vigilance), Ongole had requested the Tahsildar, Martur, Prakasam District to hand over the color granite (steel grey) slabs of 1081.11 Sq.Ft under his safe custody to Sri M.N. Kiran, Manager of M/s. Shreya Granites, Ananthapur; and the Tahsildar, Martur Mandal, Prakasam District handed over the color granite (steel grey) slabs on 14.08.2017, and obtained acknowledgment from the Manager of the firm.
The respondent-contemnor has tendered his unconditional apology, and has sought that the Contempt Case be closed.
Sri P. Girish Kumar, Learned Counsel for the petitioner, submits that the goods have been released in favour of the petitioner. While the delay in complying with the order is no doubt inordinate, we see no reason to proceed against the respondent-
contemnor, under the Contempt of Courts Act, in the light of the unconditional apology tendered by him.
The Contempt Case is, accordingly, closed.
The miscellaneous petitions pending, if any, shall also stand closed. No costs.
