This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:
"to issue a writ or order or directions more in the nature of Writ of Mandamus declaring the Final order No; P2/02/1(18)94, dated;
29-4-1995 passed by 2nd respondent herein in imposing major punishment of deferment of annual increment for a period of one year with effect on petitioner future increments without conducting the departmental enquiry and issuing show cause notice and without following APSRTC CC&A Regulations as illegal, arbitrary, contrary to Circular dated; 19-2-1999 and violation of principles of natural justice and set aside the same with all consequential benefits including restoration of increment with all attendant benefits and payment of arrears."
Heard Sri P. Govinda Rajulu, learned counsel for the petitioner and Sri A. Ravi Babu, learned Standing Counsel for respondents.
When the matter is called, it is represented by the learned counsel for the petitioner so also the learned Standing Counsel for respondents corporation that the issue in the present Writ Petition is squarely covered by the orders of this Court in W.P.No.1224 of 2011 and batch, dated 19-11-2015. It is further submitted that the said order is confirmed by Division Bench in Writ Appeal No.117 of 2016 on 1103-2016 and a copy of the same is also placed on record as material paper. Following the above said common order and for the reasons recorded therein, this Writ Petition is also allowed in part directing that the impugned orders passed by the respondent authorities shall be treated as one for stoppage of annual increments without cumulative effect. It is also made clear that the petitioner herein is also not entitled for any monitory benefits.
Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
