THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY CONTEMPT CASE No. 3280 of 2018 ORDER:
This Contempt Case is filed seeking to prosecute the respondents for their willful and intentional misrepresentation before this Court on 05.06.2018 that after completion of investigation, charge sheet was filed against the petitioner on 02.06.2018. The case of the petitioner is that he filed writ petition No.19107 of 2018 and the same was disposed of by this Court on 05.06.2018 recording the instructions given by the concerned Investigating Officer to the effect that the charge sheet against the petitioner was filed on 02.06.2018. The grievance of the petitioner is that, in fact, the charge sheet was filed after disposal of the writ petition by this Court i.e. on 29.06.2018, as such, the respondents should be punished for their willful and intentional misrepresentation before this Court under Contempt of Courts Act.
On the other hand learned Assistant Government Pleader for Home basing on the counter submits that charge sheet was filed on 02.06.2018, but the same was numbered on 29.06.2018. Though learned counsel for the petitioner submits that the petitioner obtained information by filing RTI application that the respondents filed charge sheet only on 29.06.2018, it is specifically averred in the counter filed by the respondents that they have filed charge sheet on 02.06.2018 and the same is numbered on 29.06.2018.
Learned counsel for the petitioner also failed state as to what is the prejudice caused to the petitioner in filing of charge sheet by the respondents on 29.06.2019.
In view of the same, I do not see any willful misrepresentation made by the respondents before this Court.
Accordingly, the Contempt Case is closed. No order as to costs. As a sequel to the disposal of this case, miscellaneous applications, if any, pending shall stand closed. __________________________ A.RAJASHEKER REDDY, J 27.03.2019 tk
