THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.33387 of 2015 ORDER:

The grievance of the petitioner was that the police authorities were interfering in the civil disputes relating to his real estate business. A consequential direction was sought to the police authorities not to arrest or harass him or interfere with his real estate business.

Relying on the written instructions dated 05.11.2015 received from the Station House Officer, Penamaluru Police Station, Vijayawada City, the learned Assistant Government Pleader for Home informed this Court that upon the complaint made by one Murala Venkateswara Rao, Crime No.323 of 2015 had been registered under Section 420 I.P.C. read with Section 34 I.P.C. on the file of Penamaluru Police Station, wherein the petitioner was shown as accused No.6. The petitioner was stated to have secured anticipatory bail from this Court under order dated 05.08.2015 passed in Criminal Petition No.7452 of 2015. The Station House Officer categorically denied the petitioner's averment that the police authorities had interfered in any civil disputes relating to the petitioner's real estate business and asserted that the police authorities never harassed or interfered with his business at any point of time. He further stated that after due investigation, appropriate report would be filed before the competent forum.

The aforestated stand of the police authorities is taken on record. In the light thereof, no adjudication is warranted in this writ petition on merits. The writ petition is accordingly closed. The petitioner shall however cooperate with the investigation by the police authorities. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
