This writ petition is filed stating that the petitioner is a poor person and he occupied an extent of 193 square yards of poramboke site in T.S.No.1797/1 of Eluru Municipality area in the year 1966. At that time, the said land was kept without being used for any purpose. The petitioner raised thatched house by cleaning the said land and started living with family. It is further stated that the petitioner has been in continuous and uninterrupted possession since 1966 without obstruction from anybody. The petitioner also made an application for grant of patta in respect of 193 square yards and the same was rejected vide impugned endorsement dated 23-10-2010 stating that the land in question is classified as "Gajjalavari Cheruvu" and said lands were excluded in G.O.166, dated 16-02-2008. Aggrieved by the same, the present writ petition is filed. There is no representation for the petitioner in the morning session and after-noon session.

Learned Assistant Government Pleader for Revenue submits that since the land in respect of which, the petitioner is seeking assignment falls under " Gajjalavari Cheruvu" as stated by the respondent No.3 in the impugned endorsement.

Since the petitioner is seeking assignment in respect of tank land, the respondents rightly rejected the same. Hence, I do not see any error in the impugned order.

Accordingly, the writ petition is dismissed. As a sequel thereto, miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed. _________________________ A.RAJASHEKER REDDY,J 19-02-2016 nvl
