HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.446 of 2013 ORDER:
Heard.
The complainant to the private complaint for the offence under Section 138 of the Negotiable Instruments Act in C.C.No.339 of 2009 on the file of Special Judicial First Class Magistrate(Prohibition and Excise Cases), Visakhapatnam, and he not even served, at the time of hearing for admission found there are no grounds to interfere with the C.C. taken cognizance much less to quash the proceedings.
Having regard to the above, this criminal petition is disposed of before admission without prejudice to the contest before the trial Court. Needless to say, it is left open for the petitioner to file an application under Section 205 Cr.P.C. to represent through special vakalat holder and the learned Magistrate shall consider the same with necessary conditions of personal appearance, as and when required.
As sequel to it, Miscellaneous Petitions, if any pending, shall stand dismissed.
