THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.5298 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioners/ accused in C.C.No.624 of 2015 pending on the file of X Metropolitan Magistrate, Cyberabad, at Malkajgiri, Hyderabad, arising out of Crime No.422 of 2014 registered for the offences punishable under Sections 323, 406 and 498 A IPC and Sections 4 and 6 of Dowry Prohibition Act.

Heard the learned counsel for the petitioners/accused and the learned Public Prosecutor and perused the material available on record.

After arguing for some time, the learned counsel for the petitioners confined his arguments only to the extent of dispensing with the presence of the petitioners before the trial Court. Having regard to the facts and circumstances of the case and in view of the submission made by the learned counsel for the petitioners, the presence of the petitioners 2 to 4/A-2 to A-4 is dispensed with except on the dates when their presence is specifically required for the purpose of framing of charges, examination under Section 313 Cr.P.C. and on the date of pronouncement of judgment. However, the first petitioner/first accused shall appear before the Court on his behalf and on behalf of the other accused also. The petitioners/accused shall be properly represented by their counsel.

Accordingly, the criminal petition is disposed of.

Consequently, miscellaneous petitions, if any, pending, shall stand

closed.
