THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.18521 OF 2016 ORDER:
Heard the learned counsel for the petitioner and the learned Government Pleader for Municipal Administration and Urban Development. With consent of both the counsel, the present writ petition is disposed of at the admission stage. Since this court is not going into the merits of the case, issuing notice to the unofficial respondent may not be necessary.
2 . The present writ petition came to be filed seeking issuance of writ of mandamus declaring the inaction on the part of respondent No.3 in taking action against respondent No.4 for its proposed construction of wall on public sub road No.6 of Raghavendra Nagar Co-operative Housing Society, Opposite to National Police Academy, Shivarampally Road, Ranga Redy District, as per the complaint of the petitioner dated 08.06.2016 as highly illegal and arbitrary and consequently, to direct respondent No.3 to take steps to prevent the construction of a wall.
3. Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to the 3rd respondent to consider the representation dated 08.06.2016 made by the petitioner in accordance with law.
4. Learned Government Pleader for Municipal Administration and Urban Development submits that he has no objection for the same provided the representation is still pending.
5. Having regard to the circumstances stated above, the Writ Petition is disposed of directing the 3rd respondent to consider the representation dated 08.06.2016, in accordance with law, at the earliest preferably within a period of six (06) weeks from the date of receipt of a copy of this order. Needless to mention that the petitioner as well as the aggrieved person may be heard before passing any orders on the representation made by the petitioner. Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
