THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY SECOND APPEAL No.146 of 2013 JUDGMENT:

This appeal is filed, under Section 100 CPC, assailing the judgment and decree dated 01.10.2012 in A.S.No.145 of 2011 on the file of I Additional District Court, Rajahmundry, wherein whereby the decree and judgment dated 05.12.2011 passed in O.S.No.1308 of 2006 on the file of Principal Junior Civil Judge Court, Rajahmundry, dismissing the suit filed by the plaintiff was set aside and consequently allowed the suit filed by the plaintiff directing the defendant to vacate the suit schedule property.

At the time of arguments, learned counsel for the appellant-defendant submitted that the appellant vacated the suit schedule property in the year 2015.

In view of the submission made by the learned counsel for the appellant, no further orders are necessary in this appeal. 4.

Accordingly, the second appeal is closed. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
