THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.7744 of 2015 ORDER:

This criminal petition is filed under Section 482 Cr.P.C to quash the proceedings in Cr.No.39 of 2015 on the file of Marriguda Police Station, Nalgonda District, registered for the offences punishable under section 324 r/w. Sec.34 IPC.

Heard the learned counsel for the petitioner/A3 and the learned Additional Public Prosecutor, representing the State. It is alleged that when a matter about occupation of SC colony road by non-petitioner/A1 is being discussed in the presence of elders, the petitioner/A3 along with her parents and brothers came, abused the

2nd respondent/de facto complainant and assaulted him, and in the process, the non-petitioner/A1 beat the 2nd respondent/de facto complainant on his head with a stick and caused him bleeding injury. The allegations levelled in the complaint, prima facie, reveal the commission of offences, as alleged. This is a matter, which requires investigation by the police. There are no valid grounds to quash the First Information Report.

In the facts and circumstances of the case, it is directed that the investigating agency shall proceed with the investigation, however, shall not arrest the petitioner/A3 till the investigation is completed and charge sheet is filed.

The Criminal Petition is accordingly dismissed. Pending miscellaneous applications, if any, shall stand closed in consequence.
