HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35318 of 2016 ORDER:

This writ petition is filed by the petitioners under Article 226 of the Constitution of India seeking to quash the proceedings against them in Crime No.228 of 2015 on the file of the Station House Officer, Konijerla Police Station, Khammam District.

Heard and perused the material available on record. 3.
The main grievance of the petitioners is that without there being any incriminating material against the petitioners, the 2nd respondent registered the above crime and he is causing enquiries about the petitioners. 4.
The petitioners filed this writ petition challenging the investigation in the above crime. This Court is not inclined to interfere with the investigation. However, taking into consideration the facts and circumstances of the case and the grievance of the petitioners, this Court is of the view that the investigation can be completed without arresting the petitioners.

Accordingly, respondents Nos.1 and 2 are directed to complete the investigation and file a final report in the above Crime, in accordance with law, without arresting the petitioners. The petitioners are directed to appear before the 2nd respondent as and when required. If the petitioners fail to co-operate with the investigating agency, the 2nd respondent is at liberty to secure them and complete the investigation.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
