THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.31426 of 2016 ORDER:
This writ petition under Article 226 of Constitution of India is filed seeking a direction to respondents 3 to 5 to proceed with the investigation in Crime No.47 of 2016 and take action against the accused therein.
The grievance of the petitioner is that the petitioner, who is an agriculturist, is a resident of Chandrakal Village, Peddakothapalle Mandal, Mahaboobnagar District. The 6th respondent, who is the Mandal Parishad President, got constructed the Government Water Tank in his compound by using his political influence and started using the water from the tank for all illegal purposes and never allowed the water to come freely to the villagers and the 6th respondent also used to put lot of restrictions to the villagers and as the petitioner objected him, he developed grudge against the petitioner. While so, on 17.04.2016, at about 10.00 a.m., respondents 6 and 7 came to the house of the petitioner and high-handedly removed the tap connection and abused him in the name of his caste and beat him.
The petitioner went to the Peddakothapalle Police Station and lodged a report on 18.04.2106 against respondents 6 & 7, wherein the 5th respondent registered the same as Crime No. 47 of 2016 on 19.05.2016, and till now, no action is taken against respondents 6 & 7. Considering the grievance of the petitioner, the 5th respondent is directed to complete the investigation in Crime No.47 of 2016, dated 19.05.2016, as expeditiously as possible and file a final report, if any, either way in accordance with law.
Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ____________________ RAJA ELANGO,J Date: 20th October, 2016 KL
