Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased to issue any appropriate writ, order or direction more particularly one in the nature of Writ of a Mandamus directing the respondents to consider the application of the petitioner for allotment of Fair Price Shop No.35024 of Hemachandrapuram village, Kothagudem Mandal, Khammam District in pursuance of notification of the 2nd respondent in Rc.No.
D/884/11 dated 20-08-2011 based on the written test and interview and in accordance with the guidelines issued in G.O.Ms.No.4, Consumer Affairs, Food and Civil Supplies (C.S.I) Department, dated 19-2-2011; The petition coming on for hearing, upon perusing the Petition and the affidavit filed herein and upon hearing the arguments of SRI A.RAMALINGESWARA RAO Advocate for the Petitioner and of Govt. Pleader for Civil Supplies for respondents 1 and 2, and of Govt. Pleader for Social Welfare for respondent No.3, the Court made the following: ORDER: It is represented that while entertaining Writ Petition No. 2034 of 2012 and batch, on 07.02.
" ........ Until further orders, one eligible family member or the other of the deceased fair price shop dealer shall be appointed as a temporary fair price shop dealer for a period of three months on each occasion and the same shall continue to be renewed for further periods of three months till such time the State Government announces its decision.
Further, the respondents shall not take any steps to fill up the vacancies on regular basis, even if they have finalized the selections for the said purpose. Selections may be given effect to only in the event no family member of the deceased regular fair price shop dealer comes forward with a request within fifteen days from today for appointment as a temporary fair price shop dealer. Further, if the fair price shop dealer was facing any proceedings under Section 6-A of the Essential Commodities Act, 1955, if the family members of the deceased fair price shop dealer are not interested in pursuing the same, the said factor may be taken into account and consideration while examining the desirability of offering temporary fair price shop dealership to one of the family members." Let there be a similar order even in this case.
