HONOURABLE SRI JUSTICE S.V. BHATT WRIT PETITION NO. 26978 OF 2012 O R D E R :

Heard Sri D.L. Pandu, learned counsel for the petitioner. None appears for the respondents.

2. The petitioner prays for mandamus complaining against inaction of third respondent in admitting the petitioner into MPA Folk Arts 2012-13 in spite of petitioner scoring 59 marks and giving admission to a person who secured 52 marks as illegal, arbitrary and unconstitutional.

3. I have taken note of the vehement submission of learned counsel for petitioner namely that the petitioner though has got more marks the petitioner was not admitted and secondly a person with lesser marks is admitted for the academic year 2012-13.

4. In my view, the submission of learned counsel cannot and could not he considered at this stage for two reasons; firstly, the cause relates to the academic year 2012-13 admittedly with the passage of time the academic year is over and secondly that the petitioner not only claims admission but complains against the

admission given to another person. From the cause title it is evident that the person who was admitted under BC 'D' category is not impleaded as one of the respondents.

5. For the above two reasons, I see no merit in the writ petition. Accordingly, the writ petition is dismissed. No order as to costs.

6. As a sequel, miscellaneous petitions if any, pending in this writ petition shall stand closed.
