Heard Ms.K.Hemalatha, for petitioner and learned Assistant Government Pleader (Civil Supplies).

Petitioner prays for the following relief :

"......to issue writ of Mandamus declaring the action of the respondents in not supplying the essential commodities to the petitioner's fair price shop no.34 situated at Chintalapadu Village, Tiruvuru Mandal, Krishna District as being illegal, arbitrary, unconstitutional and violative of principles of natural justice and consequently direct the respondents to release the essential commodities to the petitioner Fair Price Shop No.34 situated at Chintalapadu Village, Tiruvuru Mandal, Krishna District....."

Learned counsel for petitioner places on record show cause notice dated 18.11.2016 issued by the 2nd respondent. Through the show cause notice dated 18.11.2016 the 2nd respondent has called upon the petitioner to offer explanation on the charge framed therein. Admittedly, the issue is at the stage of consideration of explanation on the charge framed against the petitioner. The authorization of the petitioner is subsisting and there is no just reason for stopping the essential commodities to petitioner for the month of November, 2016.

The Writ Petition is disposed of by directing the respondents to supply essential commodities to petitioner Fair Price Shop No.34, Chintalapadu Village, Tiruvuru Mandal, Krishna District, as long as the authorization is in subsistence. It is made clear that this Court has not examined the charge against the petitioner or expressed any view thereon. It is for the competent authority to

decide the issue in accordance with law. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
