THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38297 of 2016 ORDER:

This writ petition is filed seeking to declare the action of the respondent police in not registering the complaint, dated 29.10.2016, submitted by the petitioner, as illegal and arbitrary. Heard and perused the material available on record. The main grievance of the petitioner is that on 28.10.2016, the petitioner came to know through his neighbouring land owner that some persons are trying to occupy his land by erecting fencing poles on the petitioner's land and that upon their illegal encroachment on the land of the petitioner, the petitioner made a report before the 3rd respondent on 29.10.2016, but the 3rd respondent is not registering the same. Considering the grievance of the petitioner, the 3rd respondent is directed to register a case, if the complaint lodged by the petitioner, dated 29.10.

2016, discloses any cognizable offence and investigate into the same and file a final report if any. If the petitioner is aggrieved by the action of the 3rd respondent, he is at liberty to approach the superior officer of 3rd respondent and also to approach the concerned Court by invoking provision under Section 200 Cr.P.C.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 8th November, 2016 KL
