THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY CRIMINAL PETITION No.8906 of 2015 ORDER:
1 This petition is filed under Section 482 Cr.P.C to quash the proceedings against the petitioner / A.2 in C.C.No.146 of 2013 on the file of the Court of the Judicial Magistrate of I Class, Anaparthi in East Godavari District.
At the time of arguments, the learned counsel for the petitioner sought permission of the Court to permit the petitioner to withdraw the petition with liberty to avail the remedies available to her under law. He further requested that the presence of the petitioner before the trail Court may be dispensed with on each and every date of adjournment. Permission is accorded. 3 In the result, the petition is dismissed granting the liberty as prayed for. Petitioner herein is the mother of the A.1 and mother-inlaw of the 2nd respondent herein. There is no dispute with regard to the identity of the petitioner who is A.2 in the case. Even if the presence of the petitioner is dispensed with, no prejudice will be caused to the 2nd respondent. Hence, the presence of the petitioner who is A.2 in C.C.No.
146 of 2013 on the file of the Court of the Judicial Magistrate of I Class, Anaparthi in East Godavari District is dispensed with on each and every date of adjournment. However, the petitioner shall appear before the trail Court as and when her presence is so required.
